There is a very real possibility that the man our Vice President shot may die. 78-year old Whittington had a heart attack today, three days after getting “peppered” by a shotgun blast to the face. How bitter would you be if you lived a long and successful life to only get shot by the Vice President of the United States.

Daily Show had a good time with it.

    The number one responsibility of a RESPONSIBLE hunter or any gun owner is to make sure you don’t shoot another human being. Do you think that a 78 year old man just ran in front of cheney’s line of fire at the last second? They were all wearing orange vests.

    Agreed DCB…and yes if he dies it would be manslaughter, that is, if anyone has the balls to charge him with it. Even then GW could pardon him in a second. Not to mention if the Veep were to be removed guess who would take his place…Dr. Rice. God save Mr. Whittington, let us all pray for him.

    The president can only grant pardons in federal crimes. Since Cheney would be prosecuted by the State of Texas, only the Texas governor could grant the pardon. Of course, in the end that’s a distinction without a difference.

    But there is a distinct difference in intent. I doubt Dick meant to shoot some old guy in the face. On the other hand, I know that Bill fully intended to commit perjury. I ain’t sayin’, just sayin’.

    Even if he’s pardoned I’d like to see this blow up into a “Bonfire of the Vanities” scandal. One little mishap brings down a life. I’m not a Democrat, but still I (and I think others) feel this incident is symbolic of the attitude of this administration.

But yeah, I know this sounds evil and all, but I kind of do wanna see dude die so that a scandal will blossom and we’ll have congressional hearings into what Elmer Fudd covered up. But then again, you don’t have to pull a trigger to be a killer now do you??

    Though he could be charged with manslaughter if Whittington dies, it’s much more likely that the district attorney, given all accounts report an accident, would charge negligence or recklessness under the applicable Texas law, and even that would be a stretch. Furthermore, anyone who wishes to see this absurdity become a real scandal is writhing in an abyss of rank partisanship and sensationalism-obsession, and should understand that they are precisely what’s wrong with this country. However, that doesn’t matter because this story doesn’t matter, and anyone who thinks it does needs a galactic readjustment of their priorities. Or, more succinctly, who fucking cares?

    rcr, you’re a lawyer you have to know that criminal negligence would be tough to show if present witnesses claim the attorney joined them from behind their line of site.

    If he dies of a heart attack, isn’t cheney off the hook, cause it wasn’t the bullet that killed him, but that fact that he woke up and realize that he had been shot in the face by the VP and now they were making fun of him on TV, and then had a heart attack?

    I doubt this matters, but evidence is coming forth that Cheney’s hunting partner strayed in an off-limits area, and that’s why he got shot.

    So in other words, he was somewhere he wasn’t supposed to be. If that’s the case, I fail to see how its reasonable to assign blame to Cheney.

    Negligent homicide would be a tough show for a lot of reasons, not the least of which is that there’s no way the DA will charge him. It’s Texas.

    We’ll never know what happened. The witnesses had 14 hours to corroborate their stories, and they’re all party players. So yes, it would be tough.

    It is the hunter’s responsibility not to shoot people.

    I can maybe understand if someone you didn’t know was there snuck up on you and jumped out as you shot, but this guy was in Cheney’s hunting party! Cheney knew the guy had just gone off in that direction looking for a bird.

    Is it too much to ask that Cheney look where he is aiming before firing?

    The guy is 78. He shouldn’t be too hard to keep track of.

    The story wreaks of negligence. To win a negligence case you need to prove four things: Duty, Breach, Causation, and Damages.

    Duty – Must prove the defendant had a duty to the victim. Hunters have a duty insure that the direction they are aiming is clear of other hunters.

    Breach – Must prove the defendant failed to act in the manner required by the duty. Cheney breached the duty of care mentioned above when he shot the victim.

    Causation – Must show the defendants breach caused the victims injuries. Cheney’s breach caused the victims injuries.

    Damages – Must show victim was hurt in some way. He was.

    So, to anyone who thinks this wasn’t negligence, why isn’t it?
